Disclaimer

STATEMENT OF LEGISLATIVE COMPLIANCE:

 

The CANCER KNOWLEDGE NETWORK, insofar as it qualifies as a “health information custodian” within the meaning of the Ontario Personal Health Information Protection Act (hereinafter referred to as “PHIPA”), acknowledges its obligations prescribed therein and states the following:

 

  1. I.                   Collection

All personal health information collected by the CANCER KNOWLEDGE NETWORK is so collected pursuant to the fully informed and knowledgeable consent of the individual; such collection thereof is necessary for a lawful purpose.  Which consent is provided pursuant to the following Notice of Purpose:

 

The CANCER KNOWLEDGE NETWORK, insofar as it qualifies as a “health information custodian” within the meaning of PHIPA, states that its collection of the consenter’s personal information is limited to that information reasonably necessary to evaluate the consenter’s health care needs, to match those needs with the services and facilities proffered by the CANCER KNOWLEDGE NETWORK’s subscribing health care practitioners, and to refer the consenter to an appropriate subscribing oncofertility specialist capable of meeting the consenter’s health care needs (“the referral”).

 

  1. II.                Storage and Security

All personal health information in the custody and control of the CANCER KNOWLEDGE NETWORK is subject to the information practices outlined in the STATEMENT OF INFORMATION PRACTICES appended hereto and marked as Exhibit “A”.

The CANCER KNOWLEDGE NETWORK shall take all steps that it, in its absolute discretion and with reference to the prescribed requirements, if any, deems to be reasonable in the circumstances to protect the personal health information in its custody and control against theft, loss and unauthorized use or disclosure and to ensure that the records containing the information are protected against unauthorized copying, modification or disposal.

The CANCER KNOWLEDGE NETWORK shall take all steps that it, in its absolute discretion and with reference to the prescribed requirements, if any, deems to be reasonable in the circumstances to ensure that the records of personal health information in its custody and control are retained, transferred and disposed of in a secure manner.

 

  1. III.             Accountability and Openness

The CANCER KNOWLEDGE NETWORK is committed to an open and accountable information management system.  Its collection, use, disclosure and storage of personal health information are subject to the information practices outlined in the STATEMENT OF INFORMATION PRACTICES appended hereto and marked as Exhibit “A”.  All inquires, requests and complaints about the CANCER KNOWLEDGE NETWORK information practices are to be directed in writing to Lorne Cooper, the CANCER KNOWLEDGE NETWORK’s contact person appointed pursuant to s.15(2) of PHIPA.

Any complaints about the CANCER KNOWLEDGE NETWORK’s information practices or any breaches thereof that remain unresolved by the CANCER KNOWLEDGE NETWORK may, pursuant to PHIPA, be directed to the Information and Privacy Commissioner appointed under the Freedom of Information and Protection of Privacy Act.

 

  1. IV.             Use and Disclosure

All personal health information used and disclosed by the CANCER KNOWLEDGE NETWORK is so used and disclosed pursuant to the fully informed and knowledgeable consent of the individual.  Which consent is provided pursuant to the following Notice of Purpose:

 

The CANCER KNOWLEDGE NETWORK states and the fact is that it will disclose the consenter’s personal health information to various subscribing health care practitioners for the sake of providing the referral, as outlined above.  The disclosure of the consenter’s personal health information is in the sole discretion of the CANCER KNOWLEDGE NETWORK; however, such disclosure will be limited to those purposes directly linked with the provision of the referral and for no other improper purpose not outlined herein.
